InPost Canada Terms & Conditions

1. Definitions

  1. InPost Canada Inc.  ("InPost Canada" or "we/us") is a company whose registered office is at 55 Brown's Line, Etobicoke, Ontario, M8W 3S2
  2. An " InPost Canada Device" is any of our self-service automatic parcel machines ("Machine", "APM", "Parcel Locker") used by you receive Parcels and obtain other services as they arise from time to time.  The main intended use is a commercial subscriber service for the convenient delivery and receipt of consumer goods and merchandise typically purchased online over the World Wide Web or Internet from reputable retail outlets
  3. "The Service" is the Parcel Delivery Service operated by InPost Canada. By using the Service, you agree that the Service is provided to you by InPost Canada
  4. or any subdomain of this URL is the online internet website used by you to register and to subscribe as a paying customer to any of the InPost Canada services and to facilitate use of any InPost Canada Device.
  5. "Parcel ID", "Barcode", "InPost Identification Number" "IID" or "Suite Number" is the InPost Identifier that is your unique identifying number allocated by us to identify you as an individual customer of InPost Canada. Your IID is the primary identification by which we determine the service preferences you have registered with us.
  6. In these Terms and Conditions "we", "our" and "us" refer to InPost Canada our subsidiaries, employees, agents and independent subcontractors
  7. "You" and "your" refer to any individual who use the service of InPost Canada
  8. "Parcel" means any container, packet, carton, bag, box, envelope or any form of package containing goods or merchandise that is accepted by us for delivery or temporary storage including any such items tendered by you utilizing our InPost Canada Device or other automated or electronic systems. A Parcel may be tendered to us on your behalf by any third party including a courier, carrier or postal operator
  9. "InPost Address" refers to the parcel receiving address for InPost's Virtual Address Service ("Virtual Address"). InPost will provide you with the correct InPost Address only after registration on our online internet website is complete.

2. Agreement to Terms and Conditions

  1. Agreement to Terms and Conditions - By using the Service, you agree to be bound by these terms for you, yourself and as agent for and behalf of any other person having an interest in any Parcel tendered to us for delivery. You agree that the Terms and Conditions included within this document are subject to change from time to time. These Terms and Conditions shall be binding on you and us, when a Parcel is accepted by us from you or from any third party on your behalf

3. Access and Use of the Service

  1. Description of the service - InPost Canada provides Parcel Delivery Services to our self-service automatic parcel machines.
  2. Acceptance - You agree that by clicking the 'I Accept' button prior to registering for an InPost account is equivalent to signing a hard-copy printed agreement between you and InPost. You may decline the terms and conditions, but if you do so, you will not be able to open an account or use InPost services
  3. Your Registration Obligations - You may be required to register with InPost in order to access and use certain features of the Service. If you choose to register for the Service, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the Service's registration form. If you are under 13 years of age, you are not authorized to use the Service, with or without registering. In addition, if you are under 18 years old, you may use the Service, with or without registering, only with the approval of your parent or guardian
  4. Your Obligations - You warrant that articles contained in any Parcel tendered to us by you or on your behalf by any third party are acceptable for transport, delivery, temporary storage and receipt by us and that the Parcel is properly marked with a valid IID and addressed. You warrant that any Parcel tendered to us is adequately packed to ensure safe delivery and transportation with ordinary care and handling
  5. Member Account, Password, Security - You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. You agree to:
    1. immediately notify InPost of any unauthorized use of your password or account or any other breach of security, and
    2. ensure that you exit from your account at the end of each session when accessing the Service. InPost will not be liable for any loss or damage arising from your failure to comply with this Section
  6. Modifications to the Service - InPost reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that InPost will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service
  7. No Transfer of Account - You may not transfer your InPost account or your account login/password to any other person
  8. Warranties and Representations - You warrant and represent that:
    1. you are at least 18 years of age or the legal age of majority in your country,
    2. you have obtained all necessary permissions to enter and perform this agreement, and
    3. you will use the InPost Service only for lawful purposes and in accordance with these terms and conditions

4. Conditions of Use

  1. User Conduct - You agree to not use the Service to:
    1. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or
    2. violate any applicable local, state, national or international law, or any regulations having the force of law; or
    3. impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; or
    4. further or promote any criminal activity or enterprise
  2. Payment - To the extent the Service or any portion thereof is made available for any fee, you will be required to select a payment plan and provide InPost information regarding your credit card or other payment instrument, or payment details so that InPost may provide you with a post-paid invoice. You represent and warrant to InPost that such information is true and that you are authorized to use the payment instrument. Data relating to transactions is processed by an authorized and secured payment service provider. InPost does not process or store such transactional information. InPost may only register your phone number and address and this, solely for the purpose of providing the Services, in accordance with the personal data protection provisions below.
    You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay InPost the amount that is specified in the payment plan in accordance with the terms of such plan and this Terms of Service. In some scenarios, you will be required to pay for services in advance, and in those scenarios you hereby authorize InPost to bill your payment instrument in advance on a periodic basis in accordance with the terms of the applicable payment plan until you terminate your account, and you further agree to pay any charges so incurred. If you dispute any charges you must let InPost know within sixty (60) days after the date that InPost invoices you. We reserve the right to change InPost's prices. If InPost does change prices, InPost will provide notice of the change on the Site or in email to you, at InPost's option, at least 30 days before the change is to take effect. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount. You shall be responsible for all taxes associated with the Services
  3. Responsibility of Payment
    1. Even if you give us different payment instructions, you will always be primarily responsible for all charges, including transportation charges, possible surcharges, penalties or fines, taxes related to any Parcel tendered to us by you or on your behalf. You will be responsible for any costs we incur in returning a Parcel to you or making alternative arrangements for delivery or disposal of any Parcel tendered to us by you or on your behalf
    2. Subject to prior express instructions given by you in writing (and accepted by us in writing) we reserve absolute discretion as to the means, route and procedure to be followed in the handling, storage and transportation of Parcels
    3. Pending forwarding or delivery, Parcels may be warehoused or otherwise held at any of our Sites at our sole discretion and the cost thereof shall be for your account
    4. We shall not be obliged to make any declaration for the purpose of any Statute or Convention or contract as to the nature or value of any Parcel or as to any special interest in delivery unless it shall have been previously and expressly instructed by you in writing and we have agreed in writing to do so
    5. Except insofar as may be required to comply with your instructions with regards to documentation or, except under special arrangements previously made in writing and we have agreed in writing to do so, we shall not be obliged to arrange for the Parcel to be carried, stored or handled separately from other parcels
    6. The costs of the Service may be payable prior to its performance or in arrears, the latter, however, is offered solely to specific senders on the basis of a separate supplemental agreement
    7. Payment prior to the performance of the Service is mandatory for all customers. For payment prior to the Service performance, the payment will be collected from your account on a periodic basis or as per the terms of this Agreement. Your account is charged solely through the system of electronic payments (via transfer or a pay card).
    8. The payment for providing the Service by us may be collected by either us or by a collecting party with the effect that your obligation to pay for the Services extinguishes against us and against the collecting party, regardless who has collected the payment from you. Choice of the collecting party remains with us
    9. InPost Canada is not a party to any contract or arrangement between you and any third party in connection with you making use of the Service. You are exclusively responsible for meeting all requirements and obligations arising out of such contract of arrangement including those related to contracts concluded at a distance
  4. Fair Use Policy
    1. In order to avoid disruption in InPost's operations and to protect the quality of services offered to the company's customers, a fair usage policy shall be applicable to unlimited delivery options provided by InPost. InPost reserves the right, at its sole discretion, to determine which users are in violation of its fair use policy
    2. InPost may offer "unlimited" delivery services for various subscription plans. The term "unlimited" shall mean that no specific predetermined limit is imposed with regard to number of deliveries scheduled. InPost reserves the right to monitor packages scheduled within its unlimited delivery plan members, and impose reasonable package limits in said plans in regard to its Fair Use Policy. Subscribers found to be in violation of InPost's Fair Use Policy will no longer be eligible for unlimited delivery subscriptions, and may be offered an alternative delivery plan option
  5. International Use - Software (defined below) available in connection with the Service and the transmission of applicable data, if any, is subject to Canadian export controls. No Software may be downloaded from the Service or otherwise exported or re-exported in violation of Canadian export laws
  6. Right to Inspect - Your Parcel(s) may, at our option or at the request of government or of any regulatory authority, be opened and contents inspected by us or by such authorities at any time, even before accepting it for dispatch.  We are under no obligation to make good or compensate you in respect of any damage or delay thereby caused to a Parcel or its contents
  7. Infringement & Counterfeit goods
    1. We respect the intellectual property rights of others, and we make efforts not to publish any material that is subject to third party copyright, trademark or other legal protections. If you believe any material on the website infringes your intellectual property rights, please inform us by submitting an Infringement Complaint
    2. InPost takes seriously the problems caused by Internet advertising and sale of counterfeit goods - which are also known as "knock offs", replicas, faux or fake products. Counterfeit goods are imitations of well-known brands. They are typically sold at prices lower than the genuine product, and they almost always bear what looks like the genuine product's trademark or logo. Ads for these products may or may not specify that they are replicas, and they are often difficult to distinguish from the genuine product - particularly in online ads where you don't have the chance to examine the goods themselves. While we make every effort to ensure that our service is not used for the sale of counterfeit goods, and we carefully select the merchants and products linked to our websites, we cannot guarantee that every item advertised and/or delivered through our cross-border shopping service is 100% authentic. But we do commit to investigate all problems
    3. If you are the rightful owner of a trademark or other intellectual property, and you know or suspect that your rights are being infringed by the advertising of counterfeit goods on any InPost website and/or the shipment of such goods through our international delivery services, please inform us by submitting an Infringement Complaint
    4. After we receive your complaint, we will conduct an investigation. If we determine that counterfeit goods infringing your rights are indeed being advertised and/or distributed through InPost, we will take appropriate action such as:
      1. removing the ad for the infringing product
      2. prohibiting the merchant of the infringing product from advertising on InPost websites
      3. disabling the customer's account if the customer is knowingly importing counterfeit goods using InPost services
      4. notifying law enforcement authorities
  8. Items not acceptable for delivery - We do not accept for delivery or storage (in no particular order and the following includes but is not limited to:
    1. Parcels greater than 380 mm x 380mm x 640mm and 20kg weight
    2. money (coins, notes, negotiable instruments equivalent to cash such as endorsed stocks and bonds). Stamps or Coins of any kind
    3. firearms, weaponry, ammunition and their parts
    4. foodstuffs, perishable food articles and beverages requiring refrigeration or other temperature or environmental control
    5. fireworks and other items of an incendiary or flammable nature
    6. explosives of any kind
    7. human or animal corpses, organs or body parts, human and animal embryos, cremated or disinterred human remains
    8. hazardous waste, including, but not limited to, used hypodermic needles and/or syringes or medical waste; blood and pathology items that present a potential biological hazard of any kind
    9. wet ice (frozen water), dry ice
    10. items requiring us to obtain any special licence or permit for transportation / export / import
    11. dead animals or animals that have been mounted or stuffed
    12. original works of art
    13. bullion or precious metals of any kind
    14. gemstones, watches and items of a high value (see limit of liability)
    15. valuables, antiques, heirlooms, items of significant sentimental value or nature
    16. age restricted materials of any kind including lottery tickets or any material where availability is restricted by law to persons over a certain age
    17. pornography or obscene material of any kind
    18. alcohol or tobacco
    19. furs or items restricted by regulatory authorities
    20. narcotics, controlled substances or illegal drugs of any kind
    21. dangerous goods of any kind that may cause harm or damage if leaked or spilled
    22. liquids unless adequately packed to contain any leakage
    23. counterfeit or contraband material of any kind
    24. perishable items
    25. items that have a pungent or strong odour or items that may cause contamination of any kind
    26. parcels that are wet, leaking or emit an odour of any kind
    27. parcels or items that may cause damage to, or delay of, equipment or personnel
    28. living creatures of any kind including animals, birds, fishes, reptiles or insects
  9. No Cash On Delivery (COD) - InPost does not perform, accept, or make use of Cash On Delivery
  10. No Liability - We exclude all liability for such Parcels listed in as not acceptable for delivery however accepted (including acceptance by mistake or under notice). We may change this list of prohibited items from time to time without prior notice or consent being sought from you
  11. Additional Restrictions - Additional restrictions may apply. We reserve the right to reject Parcels based upon these limitations or for reasons of security or safety. We are entitled to charge an administrative fee for Parcels rejected and for the costs of returning goods, where applicable, to you. Further information is available upon request

5. Intellectual Property Rights

  1. Service Content, Software, and Trademarks
    1. You acknowledge and agree that the Service may contain content or features ("Service Content") that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorized by InPost, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content (as defined below) that you legally upload to the Service. Any use of the Service or the Service Content other than as specifically authorized herein is strictly prohibited. The technology and software underlying the Service or distributed in connection therewith are the property of InPost, our affiliates and our partners (the "Software"). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by InPost
    2. The InPost name and logos are trademarks and service marks of InPost (collectively the "InPost Trademarks"). Nothing in this Terms of Service or the Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of InPost Trademarks displayed on the Service, without our prior written permission in each instance. All goodwill generated from the use of InPost Trademarks will inure to our exclusive benefit
  2. User Content Transmitted through the service
    1. With respect to the content or other materials you upload through the Service or share with other users or recipients (collectively, "User Content"), you represent and warrant that you own all right, title and interest in and to such User Content, including, without limitation, all copyrights and rights of publicity contained therein. By uploading any User Content you hereby grant and will grant InPost and its affiliated companies a nonexclusive, worldwide, royalty free, fully paid up, transferable, sub-licensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify and otherwise use your User Content in connection with the operation of the Service or the promotion, advertising or marketing thereof
    2. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Service ("Submissions"), provided by you to InPost are non-confidential and InPost will be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you
    3. You acknowledge and agree that InPost may preserve content and may also disclose content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of InPost, its users and the public. You understand that the technical processing and transmission of the Service, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices
  3. Copyright Complaints
    1. InPost respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify InPost of your infringement claim in accordance with the procedure set forth below
    2. InPost will process and investigate notices of alleged infringement and will take appropriate actions under the applicable Canadian intellectual property laws with respect to any alleged or actual infringement. A notification of claimed copyright infringement should be emailed to InPost at (Subject line: "Copyright Takedown Request").     3. To be effective, the notification must be in writing and contain the following information:
      1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest
      2. a description of the copyrighted work or other intellectual property that you claim has been infringed
      3. a description of where the material that you claim is infringing is located on the Service, with enough detail that we may find it on the Service
      4. your address, telephone number, and email address
      5. a statement by you that you have a good faith believe that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law
      6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf
  4. Intellectual Property Rights
    1. All copyright, trademarks, know how and other intellectual property rights in the software (including any device(s) upon which the software is stored) are and shall remain at all times our exclusive property
    2. You shall keep confidential the software, shall not copy the whole or any part of the software (save for security back-up copies as permitted in writing by us) and shall not without our prior written consent, modify, merge or combine the whole or any part of the software with any other software or documentation
    3. We shall have no liability in respect of, and you shall indemnify us for, any consequence, whether direct or indirect, of any failure by you or on your behalf to comply with operating instructions in respect of any software supplied by us to you.  We accept no liability for any consequences of any incompatibility between our software and your hardware and/or software
    4. It is your responsibility to ensure the input of accurate information by you or on your behalf and we shall be under no obligation to check such accuracy. The cost of rectification of any inaccuracies or their consequences shall be borne by you

6. Purchasing Products from Merchants

  1. Ordering products - You place an order with an online merchant, either through links on this website or directly from the merchant's website, or via our other Services. You will pay the merchant directly for the product and the cost of domestic shipping (if applicable), for delivery to your InPost Address. You agree to comply with any conditions and restrictions of sale which are specified on the merchant's website or which you are notified of during the purchase process
  2. Purchase transaction solely between you and the seller
    1. InPost provides services enabling you to shop online from merchants' websites and have products delivered to you at an InPost Canada Device; however, InPost does not sell the products to you. You are solely responsible for selecting and ordering the products from the merchant, and your purchase of a product is a transaction solely between you and the merchant
    2. InPost makes no representations, warranties or guarantees regarding the quality or suitability of the products you order
    3. We do not handle communications with sellers regarding product exchanges. That is your responsibility. We will, upon your request, arrange for the return delivery of item(s) ordered from the seller if the goods are still in our possession. Applicable return charges will apply
    4. If after delivery to you, you determine that any product is defective or does not otherwise meet with your expectations, you agree that you will hold InPost harmless from any liability and will seek any remedies solely from the seller

7. Refunds, Returns, Claims

  1. Lost/Damaged shipments - In the case of loss or damage to all or part of a shipment, InPost will refund the shipping charges for the affected package by the same method as you used in paying for our services where possible. Where this is not possible we will issue a credit to your account that will be applied to your next shipment
  2. Duty/Taxes - If by chance duty and taxes have not been submitted to the relevant authorities at the time of loss or damage, InPost will refund duty and taxes by the same method as you used in paying for our services where possible. Where this is not possible we would issue a credit to your account that will be applied to your next shipment. If duty and tax have been paid at the time of loss or damage, we will attempt to obtain a refund for you, although this is usually not possible
  3. Making claims - Any claims for loss or damage must be made to InPost within 14 days from the date of delivery of the package to you, failing which we will have no liability whatsoever. Claims must be made in writing, accompanied by scanned or faxed copies of the consignment note/air waybill and all supporting documents, photographs of damaged items, and relevant invoices and/or receipts for that item.   4. Product returns/exchanges - If after delivery to you, you wish to return an item to the merchant from which you purchased it, you will need to make direct arrangements with the merchant as soon as possible for any return, refund, or exchange of items in accordance with the merchant's terms and policies. Many merchants require you to obtain advance authorization for product returns and may give you a return authorization number. We will, upon request, help to arrange return shipping to the merchant from your home country, at your cost. The original customs duty and tax cannot be recouped when returning an international shipment back to the merchant

8. General Terms

  1. Modification of InPost services - We may modify or terminate our services at any time upon reasonable notice, either temporarily or permanently, without incurring any liability to you except for completing the processing of products ordered prior to the date of termination
  2. Modification of the InPost Terms & Conditions - We may modify these terms and conditions at any time without notice. Your continued use of your InPost account after the introduction of such modifications will constitute your acceptance of the modified terms and conditions.
  3. Termination - You may terminate this agreement and your use of your InPost account at any time. As noted elsewhere in these terms and conditions, we may suspend or terminate your account if you fail to comply with these terms and conditions, and in the event of such suspension or termination we will incur no liability to you
  4. Circumstances beyond our control - InPost is not liable for any loss or damage arising out of circumstances beyond our control. These include but are not limited to: natural disasters or acts of God, for example fire, earthquake, hurricane, tornado, storm, flood, fog; plane crash or embargo; war, riot, civil commotion or industrial action; epidemics or pandemics; power cuts, communications or other utility disruptions; governmental action or inaction; any defect or characteristic related to the nature of a shipment, even if known to InPost; and damage to, or erasure of, electronic or photographic images, data or recordings due to electrical or magnetic interference
  5. Indemnification - You agree to indemnify, defend and hold InPost and its shareholders, officers, directors, affiliated companies, employees and agents harmless from all claims, losses, damages, liabilities and costs (including reasonable attorneys fees) incurred by InPost which result from your use of the InPost website and InPost services, including but not limited to your negligent act or omission, any misrepresentations you make in connection with obtaining InPost services, any mis-declaration of contents or value or packages for export purposes, and/or your failure to comply with these terms and conditions
  6. Personal data protection: all personal data provided to InPost in relation to the Service will be held and processed by InPost, its servants, agents and where applicable carefully selected third companies. Such personal data shall be used fairly, in confidence and solely for the purpose of providing the Services. InPost shall keep such personal data secure and shall comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and with any relevant Canadian regulations
  7. Entire agreement - These terms and conditions (or as they may be modified from time to time) constitute the entire agreement between us for the use of the InPost website, your use of your account, and the provision of InPost services. Any other written or oral statements are superseded and of no effect
  8. Governing law - This agreement is governed by the laws of Canada, without regard to conflict of law principles
  9. Contract terms - You hereby agree and declares that the limitations and exclusions of our liability and indemnities given by you, as set out above, are fair and reasonable in all circumstances and taking into account, inter alia, the amount of our charge made for the Service
  10. Notices - Fax or letter must give all notices given pursuant to any of these Conditions. Where any such notice is given by fax, it shall be deemed to be given at the time when it is received by the recipient and in the case of any notice given by letter, it shall be deemed to have been given at the time when it would have been delivered to the recipient in the ordinary course of post.  All notices to us must be sent to our Registered Office. Any notices to you will be valid if sent to your last known home or place of business or to your registered office and if there is more than one such home or business, to any one of such homes or places of business
  11. Invalidity - If any term or provision within these Conditions shall in whole or in part be held to any extent to be illegal or unenforceable, then such term or provision or part shall to that extent be deemed not to form part of these Conditions and the enforceability of the remainder of these Conditions shall not be affected
  12. Liability and limitation
    1. We will perform our duties with a reasonable degree of care, diligence, skill and judgment. We shall be relieved of liability for any loss or damage if and to the extent that such loss or damage caused by:
      1. Strike, lock-out, stoppage or restraint of labour, the consequences of which we are unable to avoid by the exercise of reasonable diligence
      2. Any cause or event which we are unable to avoid and the consequences whereof we are unable to prevent by the exercise of reasonable diligence
    2. We accept no responsibility for departure or arrival dates or times of any Parcel and the goods contained therein. We like to deliver Parcels to one of our InPost Canada devices within Canada within 1 working day from our regional distribution centres but make no such guarantee
    3. Our liability howsoever arising and notwithstanding that the cause of any theft, loss or damage be explained or unexplained shall not exceed the replacement value of any goods stolen, lost or damaged or $100 (one hundred dollars) whichever shall be the lower. We shall not in any circumstances whatsoever be liable for indirect or consequential loss such as (but not limited to) loss of profits, loss of market or the consequences of delay or deviation however caused
    4. We are not a common carrier
    5. Any claim by you or any Addressee against us arising in respect of our Service shall be made in writing and notified to us within 14 (fourteen) days of the date upon which you became (or should have become) aware of any event or occurrence alleged to give rise to such claim. Any claim not made and notified as above shall be deemed to be waived and absolutely barred except where you can show that it was impossible for you to comply with this time limit. Notwithstanding the aforementioned time limit, we shall in any event be discharged of all liability whatsoever howsoever arising in respect of any service provided unless a claim is brought within 6 (six) months from the date of the event or occurrence alleged to give rise to a cause of claim against us
    6. We are entitled to perform any of our obligations by ourselves or by any subcontractor. Any contract to which these Conditions apply is made by us on our own behalf and on behalf of any such subcontractor who shall in addition be entitled to the benefit of these Conditions
  13. No warranties or guarantees - We make no warranties or guarantees of any kind expressed or implied, save as required by law
  14. Breach of terms and conditions - We reserve the right (without notice) to suspend, freeze or otherwise close or cease to accept Parcels from a customer reasonably suspected of knowingly or deliberately breaching these Terms and Conditions
  15. Dispute resolution
    1. In the event of any dispute arising between the parties in connection with this agreement which cannot be settled by negotiation, the parties will in good faith, seek to resolve that dispute
    2. You will settle all disputes regarding purchases you make directly with the merchant who honored the payment. InPost is not responsible for the quality, safety, legality or any other aspect of any goods or services that you purchase from merchants. InPost is not responsible for any disputes arising out of the purchase of goods or services delivered by InPost or the failure of any merchant to honor the purchase

9. Delivery to PARCEL LOCKER

    1. Delivery
      1. We reserve the right to modify and alter the procedures of performing and using the Service depending on technical considerations, in order to improve the performance of our Service and ensure their higher safety level (e.g. change or improvement to the safety solutions employed in our machines
      2. Your Parcel must comply with the requirements adopted for and the following categories ascribed to specific compartments in one of our machines:

    1. We will not accept deliveries exceeding the limits of categories indicated above.  The chargeable weight of a multi-item consignment to one addressee will be the aggregate total of each individual item rounded up to the nearest kg
    2. Should any reasonable doubt arise as to a Parcel fulfilling our requirements, we are entitled to examine its contents prior to admitting it for dispatch, the action to be followed by a decision of non-admission or else of dispatch
    3. Parcels (where collectable) are available for collection in a given machine for 72 hours after placing them in the machines. In default of the addressee collecting a Parcel on time, it will be transported to the original dispatch address and remain there for 12 days for collection. After 12 days, we will inform the Addressee (via e-mail) about the fact of return to sender
    4. On signing in our system, the Addressee must provide their email address, mobile phone number, registered by a Canadian cellular network, as well as their postal code. The Addressee bears full liability for logging in these details. The Addressee is advised to indicate complete address details during the registration procedure for collection
    5. Parcels are available for collection from our machines 24 hours a day, for 7 days in a week (24/7).  We reserve the right to make particular machines accessible at restricted hours. A Parcel will only be produced as available for collection when the correct code and phone number is provided.  If the code is lost, the Addressee is entitled to recover it by contacting our toll-free number. We will provide the restored code solely to the Addressee's e-mail address declared originally. The Addressee is fully liable for presenting the content of the text message including code before any third party. It is agreed that any person acquainted by the Addressee with the text message including the relevant code is authorized by the Addressee to collect the Parcel on their behalf
    6. Proof-of- delivery shall be in a manner at our sole discretion and may include, but shall not be limited to a signature, whether by electronic means or otherwise. We shall have no liability whatsoever as it relates to Proof-of-delivery
    7. We do not accept parcel returns. InPost does have a returns service, but its returns service is managed directly with the retailer. InPost will not process a return unless the customer has dealt directly with the retailer who has provided them with access to an InPost return label


  1. Correct addressing - You will take all reasonable measures to ensure that the products you order are correctly addressed to your InPost Address, including your name and exact suite number. Additional handling fees in identifying the recipient may apply if your package was incorrectly or inadequately addressed
  2. Our receiving procedure - We will in good faith receive packages delivered to your InPost Address. We will notify you when they are received, advise you of the actual cost of duties, taxes and international shipping/handling, and seek your instructions for shipping or storage of the packages. We will not accept parcels or packages delivered on a COD (Cash On Delivery) basis. You are the only person authorized to pay for and release the shipment, including releasing any packages addressed to your friends or family members. You cannot ship packages to individuals in any other country. Also, the payment must be via a card or payment method
  3. Loss or damage in transit to our facility - InPost will not be liable for products lost or damaged in transit from the merchant to the InPost Address facility. We reserve the right to refuse delivery at the InPost Address if, upon inspection of the outside of the package, it is obvious that the product is damaged or incomplete. In such a case, we will return the product to the sender and will notify you
  4. Relationship between you and the seller - We have no liability for any failure of a seller to ship to your InPost Address or to fulfill your order, or for any defects in any product you purchase, or any injury or damage that any product may cause, or for any other failure of the product to meet your expectations
  5. Inspection of packages
    1. InPost has the right (upon receipt, during storage, or in preparing for export shipment) to open and inspect any package, or part thereof, for security purposes and to verify compliance with export and import laws and to confirm the product description and other information you supply, without prior notice and without liability to you. However, we have no duty or responsibility to inspect packages for non-obvious damage or breakage, and we do not accept responsibility for the accuracy of product descriptions and other information provided by you
    2. If we discover that the description of the contents of the package or other information you supply is not accurate, then, depending on the specific situation, we may request you to provide additional documentation about the contents and/or their value, or we may refuse to ship it (you will be notified), or we may correct the information
    3. We may repack a product to reduce the bulk or the weight of the package, but we do not open any inner sealed, shrink-wrapped or 'designer' packaging
  6. Photographic and data records about your parcels
    1. Subject to Data Protection legislation and our Privacy Policy we may obtain and retain on record photographs of any Parcels tendered (whether or not accepted) as evidence of the condition of Parcels when they are tendered or while they remain in our care
    2. We may obtain photographs of the person(s) receiving and sending Parcels at any machine. The photographs may be used as evidence (in the event of a claim or dispute) that a Parcel was received (or sent) and / or to determine the condition of a Parcel when it was received (or sent)
    3. We ensure that any personal data revealed to us about you and/or the Addressee will be preceded solely for the purpose of performing the Service with due diligence in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and supplementary regulations and in compliance with any relevant Canadian regulations. This information will be stored on our server in Poland and you consent to this
  7. No mail accepted
    1. InPost will only process packages and envelopes containing items you have purchased. We are not a mail forwarding agency, and we do not and cannot ship documents or other mail to you. Any mail or packages addressed to you that do not contain items of value will be destroyed
    2. You may not use your InPost Address for any purpose other than receiving packages containing products you have ordered from merchants
  8. Courier disputes - You agree that you are solely responsible for your interactions with couriers and InPost will have no liability or responsibility with respect thereto. InPost reserves the right, but has no obligation, to become involved in any way with disputes between you and any courier
  9. Storage of packages/storage charges after 30 days
    1. We will store packages for you, free of charge, for a period of up to 30 days from the date received at your InPost Address. We will send you a reminder before your 30-day free storage period expires
    2. After 30 days, we will store packages but only for a maximum of another 30 days. There will be a daily storage charge, which will be payable by you at the time of requesting shipment. We will send you a reminder before this additional paid storage period expires. Any package for which you have not given us shipping instructions by the end of a total of 60 days (30 days free + 30 days paid storage) will be deemed abandoned, and we may dispose of it in any manner permitted by law
    3. Should you determine that you no longer wish to ship items stored for whatever reason, you are entitled to request their disposal. Where products can be returned to the merchant, InPost will arrange this at your cost. Any correspondence required with the merchant must be conducted by you. If the products cannot be returned to the merchant, InPost will arrange disposal. Any storage costs incurred by you remain payable
  10. Unidentified recipients
    1. Occasionally we receive packages where the appropriate recipient cannot be identified, e.g., the customer name and/or the suite address may be missing or mis-stated.
      If you have ordered a product and there is an unusual delay in receiving notification from InPost that there is a package waiting for you, you should contact customer service and describe the product you are expecting so that we can inspect unidentified packages and see if yours is there
    2. Additional handling fees in identifying the recipient may apply if your package was incorrectly or inadequately addressed
    3. Any goods received at our export facility for which an owner cannot be determined (after we have made reasonable investigative efforts) will be held for 90 days. If they remain unclaimed after 90 days, InPost will have the right to dispose of them in any manner permitted under applicable law


  1. Correct labeling - You will take all reasonable measures to ensure that the parcel you are sending is correctly labeled, and that the information contained on the label is clearly legible, and that the label is fastened securely on the parcel. Additional handling fees in identifying the recipient may apply if your package was incorrectly or inadequately labelled.
  2. Unpackaged items - You will take all reasonable measure to ensure that the parcel you are sending is correctly packaged. Additional handling fees may apply if your package was incorrectly or inadequately labelled.
  3. Multiple Shipments - There is only one parcel allowed in one compartment and that parcel must have an applicable label.
  4. One-time use - Labels can only be used once; they cannot be re-used to ship another parcel.
  5. Drop offs - Parcels can be dropped off at any InPost Parcel Locker within Canada 24/7. If the machine is somehow malfunctioning or is full, you can choose another Parcel Locker to drop off the parcel.
  6. No mail accepted
    1. InPost will only process packages and parcels. We are not a mail forwarding agency, and we do not and cannot send mail documents or other mail to you.
    2. You may not use your InPost Address for any purpose other sending and receiving packages
  7. Expiry - If a parcel is not picked up by the customer within 3 days at the destination InPost Parcel Locker, we will return the parcel back to the InPost distribution centre closest to the origin locker. The sender will have 12 days to pick up the parcel from the distribution centre free of charge. If the sender does not pick up the parcel after 12 days, we will store the parcel in our warehouse for 90 days, if collected within the 90 days, the sender may be subject to a processing fee. If no one collects the parcel within 90 days, InPost will destroy the parcel.
